Step 1 — classify the offence
Use the Second Schedule to the Code to find whether the offence is bailable.
Step 2 — apply the right section
- Bailable (s.496): release on bail is a right.
- Non-bailable (s.497): release is discretionary. Bail should not be granted where there are reasonable grounds to believe the accused is guilty of an offence punishable with death or imprisonment for life — unless the proviso applies (under sixteen, a woman, or sick or infirm).
- Superior courts (s.498): the High Court Division and the Court of Session may grant bail in any case.
Step 3 — conditions and cancellation
Courts may impose conditions, and bail may be cancelled under section 497(5) where the accused misuses the liberty granted.
