| Situation | Section | Result |
|---|---|---|
| Caused by inducement, threat or promise from a person in authority | 24 | Irrelevant in a criminal proceeding |
| Made to a police officer | 25 | Cannot be proved against the accused |
| Made in police custody, not in a Magistrate’s immediate presence | 26 | Cannot be proved against the accused |
| Information leading to discovery of a fact | 27 | Provable so far as it distinctly relates to the fact discovered |
| Made after the impression of inducement is removed | 28 | Relevant |
| Made under a promise of secrecy, or while drunk | 29 | Not irrelevant for those reasons alone |
| Confession of a co-accused tried jointly | 30 | The court may take it into consideration against the others |
Exam tip: examiners often combine sections 25 and 27 in one fact pattern. Deal with exclusion first, then discovery.
